The breeder guarantees the above described dog to be healthy at the
time of the sale. The breeder does not assume any liability for any injuries
made to puppy after delivery due to the negligence of the buyer.
The buyer agrees to have this puppy examined by a veterinarian within 3
days of delivery. If the buyer chooses not to have puppy examined within 3 days,
this contract will become null and void .The buyer must email or fax the breeder
the written report from the veterinarian immediately.
All vet charges and expenses will be paid by the buyer. Seller will not be
responsible for any vet bills incurred by buyer.
Breeder provides a one (1) year genetic health guarantee. Should the
puppy expire within the first year of ownership DUE TO A GENETIC DEFECT
CAUSED BY THE BREEDER, BREEDER will replace the puppy under the
following conditions:
1. Buyer agrees that should puppy expire for unknown reasons within 1 year and buyer
requests another puppy that an autopsy should be preformed on the puppy and a written statement
by a veterinarian is to be provided to the breeder with the exact cause of death.
At cost to buyer. If the puppy expired due to the negligence of the breeder then a replacement puppy will be provided at no cost.
Buyer will pay shipping.
2. If the puppy is found to have life threatening genetic problem due to
the breeder within the first year of ownership then a replacement puppy
will be provided upon written proof from veterinarian with EXACT cause of
illness. The buyer agrees to return the puppy and any registration papers to
breeder before providing replacement puppy. Buyer to pay shipping.
These fatal and life altering conditions include-severe Hip
Dysplasia, Heart ,Pancreas and Spine conditions.
This guarantee does not include Coccidia and common Respitory
conditions, which are usually caused by bacteria and like the common cold
must run its course, Elongated Soft Palate, Stenotic Nares
(Collapsed Nostrils) Cherry Eye, Loose Hips, Skin Allergies, these are
considered normal in the breed.
The buyer agrees to maintain the puppy's health in good condition, and
to provide yearly examinations, vaccinations, and any other customary
procedures necessary to assure good health.
The breeder has done everything possible to produce healthy sound
puppies and by raising the puppies in the best way possible in regards to
diet, exercise, socialization and veterinarian care. All necessary
vaccinations and wormings for the puppy's age have been given, and a
record of this vaccination history is supplied to buyer at time of sale.
Breeder cannot guarantee puppy to be of breeding or show quality.
LIMITED REGISTRATION
Non-placement policy. (1) Should the buyer ever decide to part with
this dog, become incapable of caring for this dog, or be forced to surrender
ownership of this dog, the buyer agrees that the dog shall be returned to
seller. (2) Buyer must contact seller by registered letter at the address
provided at time of purchase stating their intent to relinquish ownership of
this dog. Seller shall have two week (fourteen days) to respond to letter and
arrange to either take possession of the dog, or have alternate arrangements for
care made for this dog. (3) If buyer sells, trades, surrenders to a shelter or
rescue group or gives away this dog to any party, without first notifying seller
by registered letter as outlined above, and then obtaining express written
permission from seller to do so, seller may pursue legal damages for pain
and suffering incurred as a result of this unwarranted transfer of ownership.
(4) The Buyer agrees to pay any and all court costs and lawyer fees incurred by
the seller associated with enforcing this policy.
This penalty exists to emphasize the importance seller places on this
dog’s lifetime well-being and to insist on their rights to remain informed and
involved in the choice of home for this dog.
The breeder neither makes or implies any warranties or
guarantees, expresses or implied, other than those written in the
agreement. This document constitutes the entire agreement between the
breeder and buyer with respect to this sale. The buyer's signature below
that they have read and understand all the conditions of the sales
